Terms of Use for Guests

As of: October 2026. This is a translation of the German AGB; in case of doubt, the German version applies.

§ 1 Scope

  1. These terms apply to the use of the website mokkna.de and all services of Mokkna, Abdelsalam Abdelmoaty, Lychener Str. 53, 10437 Berlin, Germany (“Mokkna”, “we”), by guests who search for or request a venue for an event (“guest”, “you”).
  2. Separate terms (the listing agreement) apply to venues.
  3. Any different terms of the guest do not apply, including a company's own terms. If a company books, § 11 also applies.

§ 2 Mokkna's services

  1. Mokkna arranges venues for private occasions in Berlin. We present venues and event packages, receive requests, pass them on to suitable venues and support the booking.
  2. Our services are free for guests. Mokkna receives a commission from the venue.
  3. Mokkna acts only as an intermediary. We do not rent out the venues and do not organise the event.
  4. Information on venues and packages (prices, capacity, equipment, availability) comes from the venues. We check it carefully but cannot guarantee that it is correct.

§ 3 Requests and contract

  1. A request through our form is not binding.
  2. We send you one or more offers from venues with price, services and conditions (including cancellation and deposit rules).
  3. The rental contract for your event is concluded only when you accept an offer and the venue confirms it. The contract is solely between you and the venue.
  4. You must be at least 18 years old to send a request.

§ 4 Prices and payment

  1. The venue's prices in the offer apply. Prices for consumers include VAT.
  2. You pay rent, deposit and extras directly to the venue, under its terms. Mokkna charges you no fees.

§ 5 Cancellation and withdrawal

  1. Cancellation is governed by the venue's terms stated in the offer.
  2. For contracts renting rooms for an event on a specific date, there is generally no statutory right of withdrawal (§ 312g(2) no. 9 BGB). The venue's terms apply.
  3. Because our service is free, withdrawing a request costs you nothing at Mokkna.

§ 6 Guest obligations

  1. You provide true and complete information (in particular number of guests, occasion and date).
  2. You follow the venue's house rules (e.g. end time, noise, smoking) and make sure your guests do too.
  3. You do not contact venues found through Mokkna in order to bypass Mokkna.

§ 7 Liability

  1. Mokkna is liable without limit for intent and gross negligence and for injury to life, body or health.
  2. For slight negligence, Mokkna is liable only for breach of essential contractual obligations, limited to the foreseeable, typical damage.
  3. The venue alone is liable for its services (condition of the rooms, running of the event, cancellations).
  4. Liability under the Product Liability Act remains unaffected.

§ 8 Data protection

§ 9 Changes to these terms

We may change these terms for future requests. A current request is governed by the version in force when you sent it.

§ 10 Final provisions

  1. German law applies. If you are a consumer, this choice of law applies only as far as it does not remove mandatory consumer protection rules of your country of residence.
  2. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
  3. If any provision is invalid, the remaining provisions stay valid.

§ 11 Additional terms for businesses

  1. These terms apply if you book as a business (Unternehmer under § 14 BGB), e.g. for a team event, Christmas party or client event. Startups, freelancers and associations with a commercial purpose also count as businesses.
  2. Anyone requesting on behalf of a company confirms they are authorised to do so. The company becomes the venue's contracting party.
  3. Offers to businesses may show net prices plus VAT. The offer states this. The venue issues the invoice.
  4. For slight negligence, Mokkna is not liable to businesses for indirect damage or lost profit. § 7(1) and (4) remain unaffected.
  5. You report defects or complaints about Mokkna's service in text form within 14 days after the event.
  6. If the guest is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Berlin.
  7. § 10(1) sentence 2 (consumer protection of your country of residence) and § 10(2) (consumer arbitration) do not apply to businesses.
